weareonaboat is a web service built on the Sharetribe platform. The general terms of Sharetribe below apply also to the use of weareonaboat

Sharetribe is a social media service that allows its users to change favors and items and communicate with each other. The Sharetribe-service may only be used in accordance with these terms of use. The service provider reserves the right to change these terms of use if required. Valid terms of use can be found from Sharetribe’s website.

Rights of Content

The users themselves retain the right to all text, pictures and other content that they create in the service. The users allow others to utilize the content in accordance with the nature of the service and furthermore allow the service provider to file information and data and make changes that are necessary for the service or the study, however other rights are not transferred from the users, unless specifically otherwise agreed. The responsibility of the content lies with the user, who has produced it to the service. The service provider has the right to remove any material when it deems it necessary.

Disclaimer

No guarantees of the functioning of the weareonaboat service are given. The users are themselves responsible for their actions in the service and they should estimate the reliability of other users before dealing with them. The service provider can under no circumstances be liable for damage that is caused to the user. The user may not store any information or data in the service, and expect it to remain there.

The Removal of a User

The service provider has the right to remove any users from Sharetribe and terminate their right of use of the service without any specific reason and without being liable for compensation.

Applicable Jurisdiction

The jurisdiction that is applicable in this service and these terms of use is that of Finland, unless something else is required by binding law.

TERMS OF SERVICE

PLEASE READ THESE TERMS OF USE ("AGREEMENT" OR "TERMS OF USE") CAREFULLY BEFORE USING THE WEBSITE, MOBILE APPLICATION, AND SERVICES OFFERED BY "WE'RE ON A BOAT". THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE "WE'RE ON A BOAT" MOBILE APPLICATION AND WEBSITE PROVIDED BY "WE'RE ON A BOAT".

By using the website, mobile application, and services (collectively, the “We're on a boat Platform”) in any manner, including but not limited to visiting or browsing the Site, you (the "user" or "you") agree to be bound by this Agreement, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. This Agreement applies to all users of the Site, including without limitation users who are vendors, customers, merchants, contributors of content, information and other materials or services on the Site.

"We are on a boat" reserves the right to modify the terms and conditions of this Agreement or its policies relating to the "We are on a boat" Platform at any time, effective upon posting of an updated version of this Agreement on the "We are on a boat"  Platform. You are responsible for regularly reviewing this Agreement. Continued use of the "We are on a boat" Platform after any such changes shall constitute your consent to such changes.

"WE"RE ON A BOAT" IS AN INTERACTIVE TECHNOLOGY SERVICE AND BOATSHARING PLATFORM THAT PROVIDES A MOBILE FORUM FOR ENABLING PEOPLE LOOKING FOR A SHARED BOAT RIDE TO REQUESTS RIDES FROM CAPTAINS WHO CAN PROVIDE SUCH SERVICE. "WE"RE ON A BOAT" DOES NOT PROVIDE TRANSPORTATION SERVICES, AND IS NOT A TRANSPORTATION CARRIER. IT IS UP TO THE CAPTAIN OR BOAT OWNER TO DECIDE WHETHER OR NOT TO OFFER A BOAT RIDE TO A PASSENGER CONTACTED THROUGH THE "WE"RE ON A BOAT" PLATFORM, AND IT IS UP THE PASSENGER TO DECIDE WHETHER OR NOT TO ACCEPT A RIDE FROM ANY CAPTAIN CONTACTED THROUGH THE "WE'RE ON A BOAT" PLATFORM. ANY DECISION BY A USER TO OFFER OR ACCEPT A BOAT RIDE ONCE SUCH USER IS MATCHED THROUGH THE "WE'RE ON A BOAT" PLATFORM IS A DECISION MADE IN SUCH USER’S SOLE DISCRETION. "WE'RE ON A BOAT" OFFERS A METHOD TO CONNECT CAPTAINS AND PASSENGERS WITH EACH OTHER, BUT DOES NOT AND DOES NOT INTEND TO PROVIDE TRANSPORTATION SERVICES OR ACT IN ANY MANNER AS A TRANSPORTATION CARRIER, AND HAS NO RESPONSIBILITY OR LIABILITY FOR ANY TRANSPORTATION SERVICES VOLUNTARILY PROVIDED TO ANY PASSENGER BY ANY CAPTAIN USING THE "WE'RE ON A BOAT" PLATFORM.

Eligibility

You may use the "We're on a boat" Platform only if you can form a agreement with "We're on a boat" , and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Any use or access to the "We're on a boat"  Platform by anyone under 16 is strictly prohibited and in violation of this Agreement. The "We're on a boat"  is not available to or authorized for use by any users previously removed from the "We're on a boat"  Platform by "We're on a boat" , any users or persons acting on behalf of an organization or entity and not in his or her personal or individual capacity, or any users accessing the "We're on a boat"  Platform for any purpose other than to seek to participate in an actual boat ride for personal purposes, unless specifically authorized by "We're on a boat" (collectively “Unauthorized Users”). Unauthorized Users are strictly prohibited from accessing or attempting to access, directly or indirectly, the "We're on a boat" platform. Any such unauthorized use is strictly forbidden and shall constitute a violation of Federal and applicable state and local laws.

"We're on a boat"  Platform. Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the "We're on a boat"  Platform for personal, noncommercial use only and as permitted by the features of the Service and applicable law, including but not limited to state boat share and boatpool exemptions. "We're on a boat"  reserves all rights not expressly granted herein in the Service and the "We're on a boat"  Content (as defined below). "We're on a boat"  may terminate this license at any time for any reason or no reason.

ACCOUNT REQUIREMENTS

For all "We're on a boat" accounts, you may never use another User’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must notify "We're on a boat" immediately of any breach of security or unauthorized use of your account. "We're on a boat" will not be liable for any losses caused by any unauthorized use of your account.

ANTI-DISCRIMINATION

USERS ARE PROHIBITED FROM MAKING ANY NEGATIVE RATING, CONDUCT OR SPEECH ON THE BASIS OF OR INFLUENCED BY GENDER, RACE, ETHNICITY, ABILITY, DISABILITY, SEXUAL ORIENTATION, AGE, LACK OF A VOLUNTARY DONATION OR OTHER IMPERMISSIBLE CATEGORY UNDER APPLICABLE LAW.

ENTIRE AGREEMENT/SEVERABILITY

This Agreement, together with any amendments and any additional agreements you may enter into with "We're on a boat"  in connection with the Service, shall constitute the entire agreement between you and "We're on a boat"  concerning the Service. If a court of competent jurisdiction deems any provision of this Agreement invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

NO WAIVER

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and "We're on a boat"  failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

Fee

We are on a boat charges 14% commission over the total booking amount. The 14% will be deducted from the total booking amount. Paypal charges a comission between 2%-5% deppending of the country where you are.
